What is FSSAI?

The Food Safety and Standards Authority of India (FSSAI) is an autonomous body that is established directly under the Ministry of Health and Family Welfare, Government of India, which directs it to take care of and promote public health in the country. The regulation and supervision of food safety across our nation are taken care of by the FSSAI which follows the guidelines given by the Food Safety and Standards Act, 2006.

Each state in the country has its own FSSA to provide FSSAI registration and State FSSAI license. The central FSSAI license is issued by the central unit which administers all of the state units together.

Why should I get FSSAI registration?

Since Food businesses functioning without the necessary paperwork can be dangerous and can be shut down permanently with a high value of fines, the Delhi Police Act makes FSSAI registration compulsory for every food business operator, prioritizing the safe health of people to have an FSSAI certificate.

What are the roles and responsibilities of FSSAI?

The key roles and responsibilities of the FSSAI registration are as follows:

  • Development of international technical standards for food
  • Setting food safety standards by framing the required regulations

What are the types of FSSAI licence?

1. FSSAI Basic license

The basic registration is done for small-sized businesses and startups. The annual turnover of the business must be less than Rs. 12 lakh and the approval for this registration is given by the state government.

Eligibility:

Food businesses that run with an annual turnover of less than 12 lakh as wholesalers, distributors, suppliers, retailers, food vendors, hawkers, clubs, canteens, dhabas, hotels, restaurants, makeshift stalls, businesses selling food other than caterers, storages, cottage industries, producers/processors of vegetable oil with a capacity of not more than 100 kg/liter per day, diary units with a capacity of not more than 500 liters per day, and slaughterhouses with a capacity not more than 2 large animals/10 small animals/50 poultry birds per day fall into this section.

2. FSSAI State license

The state registration is done for medium-sized businesses that are localized in a single state and expect to have many branches registered for State FSSAI license. This license is issued by the respective state government and to fit into it, the annual turnover of the business must be more than 12 lakh and less than 20 crores.

Eligibility:

Food businesses that run with an annual turnover that lies between 12 lakh to 20 crores as suppliers, wholesalers, distributors, retailers, food vendors, dhabas, clubs, canteens, restaurants, proprietary food sellers, hotels having 4-star ratings or less, storages having a capacity that is less than 50000 metric tons yearly, producers/processors of vegetable oil with a turnover within 12 lakh to 20 crores annually, and slaughterhouses with a capacity, not more than 50 large animals/150 small animals/1000 poultry birds per day fall into this section.

3. FSSAI Central license

The central registration is done for food business operators like importers, 100% export-oriented units, large manufacturers, airports, seaports, central government agencies, etc. This license is issued by the central government and should be procured for the head office of a business since the business functions in more than 1 state of the country. The annual turnover of the business must exceed 20 crores.

Eligibility:

Food businesses that run with an annual turnover exceeding 20 crores as restaurants, suppliers, distributors, retailers, food vendors, dhabas, clubs, canteens, proprietary food sellers, hotels having 5-star rating or more, storages having a capacity that is less than 50000 metric tons yearly, producers/processors of vegetable oil with a turnover of more than 20 crores annually, wholesalers having an annual turnover of more than 30 crores, and slaughterhouses with a capacity more than 50 large animals/150 small animals/1000 poultry birds per day.

Other than this, re-packers, exporters, and importers involved in food production or processing, storages having a capacity of more than 50,000 metric tons, caterers working under the central government or related agencies such as railways, airways, seaports, defense, etc., fall into this section.

FSSAI registration process – Procedure, documents, and cost.

Procedure to apply for Basic FSSAI license

  • Sign up for the FSSAI License website and enter the Basic details
  • Select Basic FSSAI registration and fill the FSSAI Registration Form A
  • Provide the important documents required for basic registration
  • Once the application is submitted, the approval takes place within 7 days
  • If the application is approved, the certificate will be mailed along with the FSSAI License number information

Documents required for Basic FSSAI license

The documents required for basic FSSAI registration are:

  • Declaration form
  • Authority letter
  • 2 photographs of the applicant
  • Copy of the property paper (if owned) or copy of the Rental Agreement (for the property)
  • License/plan of the food safety management system
  • Electricity bill/water bill of the place of business
  • Identification proof of proprietor/partners/directors (Aadhar Card, Voter ID card)
  • FORM IX
  • Any other supporting documents like NOC from Municipality/Panchayat and Health NOC

Procedure to apply for State FSSAI License

  • Sign up on the FSSAI License website, select State FSSAI registration, and fill the FSSAI registration FORM B
  • Submit the important documents required for State license registration
  • Once the application is submitted, the approval takes place within 15-30 days
  • If the application is approved, the certificate will be mailed along with the FSSAI License number information

  • Blueprint of the processing unit
  • List of Directors/Partners with the complete address and contact details
  • A list of the equipment and machinery to be used
  • Installation capacity and horsepower to be used in manufacturing
  • ID and Address proof
  • List of the food categories planned for manufactured
  • Authority letter
  • The analysis report of the water to be used in the manufacturing process
  • Copy of the property paper (if owned) or copy of the Rental Agreement (for the property)
  • Electricity bill/water bill of the place of business
  • Partnership Deed/Affidavit of Proprietorship/Memorandum & Articles of Association
  • Copy of certificate obtained under Coop – 1861/Multi-State Coop Act – 2002
  • NOC & Copy of License from the manufacturer
  • Declaration and Undertaking by the Food Business Operator
  • Food Safety Management System Plan/certificate.
  • Source of milk/procurement plan for milk including the location of milk collection centers
  • Sources of raw material for meat & meat processing plants.

Procedure to apply for Central FSSAI license

  • Sign up on the FSSAI License website and fill in the FSSAI Registration Form B
  • Submit the important documents required for Central licence registration. To add a new product, click on ‘Select Food Category’ in the Food Processing Unit screen and select the required food category
  • Submit the form and FSSAI Application will be created which will be passed for approval from the FSSAI department
  • Once the application is submitted, the approval takes place within 30-40 days
  • If the application is approved, the certificate will be mailed along with the FSSAI License number information

Documents required for Central FSSAI license

  • FSSAI license declaration form
  • Copy of the certificate received below the Coop Act – 1861 / Multi-State Coop Act – 2002 in case of Cooperatives (if applicable) is needed
  • Completed and signed FORM B by the Partner, Authorized Signatory/Proprietor
  • A list of the equipment and machinery to be used
  • DGFT document of the IE code
  • Proof of turnover in the supporting documentation
  • NOC from the local body/Municipality (optional)
  • Certificate given by the Ministry of Tourism (for hotels)
  • PA/NOC documents circulated by FSSAI
  • Copy of License and NOC from the manufacturer as it is compulsory for Repackers, and Relabellers
  • Copy of the property paper (if owned) or copy of the Rental Agreement (for the property)
  • List of Directors/Partners, Executive Members of Society, Proprietor, Trust with the complete address and contact details
  • Chemical & Bacteriological analysis report of the water to be used in the manufacturing process
